Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, products, and services (collectively, the “Services”) offered by Agent Match (“Agent Match,” “Company,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not access or use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” refers to that entity.

Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that the information you provide to us is accurate and complete.

The Services

Agent Match connects consumers, loan officers, and other referral partners with third-party real estate professionals and related service providers. We are not a real estate brokerage, mortgage lender, law firm, or financial advisor, and we do not provide real estate, brokerage, lending, legal, tax, or investment advice. Any real estate, lending, or related services are provided solely by the independent third-party professionals, not by Agent Match.

We do not guarantee that any match, referral, introduction, or transaction will result from your use of the Services, nor do we guarantee any particular outcome, price, or result. Your decision to engage any professional, and the terms of any agreement you enter with them, are solely between you and that professional.

Accounts and Registration

Some features of the Services require an account. You agree to provide accurate information, keep it current, and maintain the security of your login credentials. You are responsible for all activity that occurs under your account. Notify us promptly at contact@agentxmatch.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Communications and Consent

By providing your phone number or email address and opting in where prompted, you consent to receive communications from us and from professionals we connect you with, including calls, text (SMS/MMS) messages, and emails related to your inquiry and our Services. Message and data rates may apply, and message frequency varies. Consent is not a condition of purchasing any goods or services.

You may opt out of marketing emails via the unsubscribe link in any such email, and you may opt out of text messages at any time by replying “STOP” to any message. For more detail on how we handle your information, see our Privacy Policy.

Acceptable Use

You agree that you will not:

• Use the Services for any unlawful, fraudulent, or unauthorized purpose, or in violation of any applicable law or regulation (including telemarketing, consumer-protection, fair-housing, and privacy laws).
• Submit information about another person without their authorization, or submit false, misleading, or inaccurate information.
• Interfere with or disrupt the Services, attempt to gain unauthorized access to any systems or accounts, or circumvent any security or access controls.
• Copy, scrape, harvest, or use automated means to access or collect data from the Services without our prior written consent.
• Infringe the intellectual property, privacy, or other rights of Agent Match or any third party.

Third-Party Professionals and Links

The Services may introduce you to, or contain links to, third parties and their websites or services. Agent Match does not control, endorse, or assume responsibility for any third party, their conduct, or their products, services, or content. Any dealings you have with a third party are solely between you and that third party. We encourage you to perform your own due diligence, including verifying licensing and credentials, before engaging any professional.

Intellectual Property

The Services, including all content, features, functionality, trademarks, logos, and software, are owned by Agent Match or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Agent Match disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, that any information will be accurate or reliable, or that any match or referral will meet your expectations.

Limitation of Liability

To the fullest extent permitted by law, in no event will Agent Match, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Services or any interaction with a third-party professional, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Services will not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Agent Match and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts, except where prohibited by applicable law.

Changes to These Terms

We may modify these Terms from time to time. If we make changes, we will update the “Last modified” date above. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. Please review these Terms periodically.
